Policy and Procedure for Takedown Requests
anadro.id respects the intellectual property rights of others and expects the same respect from third parties towards its own rights. Under the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c), a copyright owner or their authorized representative may submit a takedown request through our contact page. As an internet service provider, we are entitled to assert immunity from such infringement claims under the DMCA's “Safe Harbor” provisions. To file a valid infringement claim with us, your notice must include the following information:
Notice of Infringement – Claim
1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
2. Identification of the copyrighted work claimed to be infringed;
3. Identification of the infringing content to be removed, along with sufficient details to allow the service provider to locate the material. (Submitting the URL of the page in question helps in identifying the purportedly infringing work);
4. Adequate information to allow the service provider to contact the complainant, including name, physical address, email address, and phone and fax numbers;
5. A declaration that the complainant believes in good faith that the material's use is not authorized by the copyright agent; and
6. A statement that the information in the notice is accurate and, under penalty of perjury, that the complainant is authorized to act on behalf of the copyright owner.
Title 17 USC §512(f) imposes civil damage penalties, including costs and attorney fees, against anyone who knowingly and materially misrepresents certain information in a notification of infringement under 17 USC §512(c)(3).
Counter Notification – Restoration of Material
If you have received notification of material being taken down due to a copyright infringement claim, you may submit a counter notification to attempt to have the material reinstated on the website. This notification must be in writing and should contain substantially the following information pursuant to 17 USC Section 512(g)(3):
1. Your physical or electronic signature.
2. A description of the material that was removed and its original location before removal.
3. A declaration under penalty of perjury that you believe the material was erroneously removed or disabled due to a mistake or misidentification.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the district where your address is located, or if outside the United States, to the jurisdiction of any judicial district in which the service provider may be found, and that you will accept service of process from the person or entity who provided the original infringement notification.
Please submit your counter notice through our contact page.
